Terms & Conditions

Legal Contract
This is a legal contract (“Contract”). By purchasing it, you understand that it is such a contract and acknowledge that you have had the opportunity to read the terms and conditions set forth herein. You must retain Your Contract receipt (“Receipt”), which contains information about the term of the contract, the purchase price of the Contract (“Contract Purchase Price”), and the covered goods (“Product(s)”). Unless revised by Us with at least thirty (30) days' advance written notice to You, this Contract (including its terms, conditions, limitations, exceptions, and exclusions) and the Receipt constitute the entire agreement, and no representation, promise, or condition not contained herein shall modify these terms. This is not a contract of insurance. 

Definitions. 
“We,” “Us,” and “Our” mean the company obligated under this Contract, as follows: WAWGD Newco, LLC dba Foresight Sports, located at 9955 Black Mountain Road, San Diego, CA 92126, with phone number (858) 880-0179. “You” and “Your” mean the individual who purchased this Contract. Your name and address are set out on the Receipt. 

What This Contract Covers. 
This Contract covers the replacement of Your Product in the event of a Covered Incident, as defined herein, during the Term. Replacement units will be new or refurbished and certified by Us to meet original performance specifications. This Contract covers all shipping charges for Us to send the replacement Product to You, and for You to return the original Product to Us.

OUR TOTAL LIABILITY UNDER THIS CONTRACT RELATING TO all claims that You make pursuant to this CONTRACT shall not exceed the PURCHASE PRICE OF THE PRODUCT.

Covered Incident(s). 

  • Subject to the excluded causes outlined in “What This Contract Does Not Cover” below, Your Product will be eligible for replacement under this Contract, only in the event of: 
  • Accidental damage, including drops, impacts, and mishandling; or 
  • hardware failure resulting from normal use, or 
  • Power, sensor, and connectivity issues related to covered components 

What This Contract Does Not Cover.  
This section sets out what is not covered by this Contract. That means that We will not provide coverage of any kind under this Contract for the following: 

  • Damage to goods that have missing or altered serial numbers. 
  • Damage resulting or arising from: 
  • Normal wear and tear; 
  • unauthorized modifications to the product, including the unauthorized removal, bypass, or disabling of safety features;  
  • unauthorized repairs; 
  • intentional damage or the misuse or abuse of the product;  
  • the introduction of foreign objects into the product; 
  • Acts of God, war, invasion or act of foreign enemy, terrorism, cyberattack, hostilities, civil war, rebellion, strikes, lockouts, labor disturbances, or civil commotion; 
  • third-party acts, including theft and vandalism; 
  • failure to perform preventative maintenance, as outlined in any accompanying instructional booklets or information; 
  • freezing or overheating not caused by a mechanical or electrical breakdown or defect; or 
  • any cause other than normal use and operation of the Product in accordance with the manufacturer's specifications, instructions, or owner's manual. 
  • Furthermore, this Contract does not cover: 
  • cosmetic damage repair, cleanings, and alignments; 
  • consequential and incidental damages, including loss of use of the product, loss of business or down-time, property damage, or lost data RESULTING FROM THE FAILURE OF ANY PRODUCT OR FROM DELAYS IN SERVICE OR THE INABILITY TO RENDER SERVICE. 
  • consumable parts such as batteries; 
  • preventative maintenance; 
  • liability for bodily injury, death, or property damage arising out of the use, operation, or maintenance of the Product; 
  • the cost of outside labor for reinstallation; 
  • damage incurred during shipping due to Your failure to safely package the Product. 
  • There is no coverage if We determine that Your Product does not qualify as a Covered Incident under the terms of this Contract. 

Requesting replacement.  
If You believe Your Product is experiencing a breakdown or defect due to a Covered Incident, You can file a request for replacement under this Contract by contacting Foresight Sports Support.  You must provide a copy of the Receipt and a detailed explanation of the issue Your Product is experiencing to validate Your request. You must protect Your Product against further damage throughout the replacement process. 

Request processing.  
Upon receipt of Your request for replacement, We will review your request for eligibility under this Contract and provide a determination to You within two (2) business days.  

Eligible request fulfillment.  
If we determine that your Product is eligible for replacement under this Contract, We will ship a replacement Product to You within two (2) business days. Replacement fulfillment is subject to product availability and shipping destination. Delivery timelines may vary based on Your location, carrier transit times, and Our inventory levels. International shipments may require additional time. 

Your responsibilities.  
Upon issuance of a replacement Product, You will receive a prepaid shipping label from Us for the return of the original (faulty) Product. The original Product must be returned to Us within 30 days of the replacement Product shipment date.  The returned Product must be the same Product originally covered under this Contract and Your replacement request, and must be returned without additional damage beyond the reported issue. Failure to return the original Product in this condition and within this timeframe may result in You being charged the full retail value of the replacement Product. 

Coverage Term.  
The term of the Contract ("Term") begins on the purchase date as reflected on the Receipt and continues for a period of one (1) year. 

Renewal.  
This Contract is not renewable. 

Cancellation by You. 
You may cancel this Contract at any time for any reason either by logging into [WEBSITE] or calling [TOLL-FREE PHONE NUMBER].  
If You cancel this Contract within [NUMBER] days after purchasing this Contract, You will receive a full refund of the Contract Purchase Price.  
If You cancel this Contract after the first [NUMBER] days from the purchase of this Contract, You will receive a pro rata refund of the Contract Purchase Price based on the time remaining on the Contract. 
We will pay the applicable refund within 10 days of Your cancellation. If You properly cancel under Section 10(a) and We fail to pay the refund within 10 days of Your cancellation, We will pay an additional ten percent (10%) penalty per month. 

Cancellation by Us.  
This Contract may be cancelled by Us for any reason by notifying You in writing at the address indicated on the Receipt at least [NUMBER] days prior to the effective date of cancellation. The notice will state the effective date and reason for cancellation. If We cancel this Contract, You will receive a pro rata refund of the Contract Purchase Price based on the time remaining on the Contract. We will pay the applicable refund within [NUMBER] days of cancellation. 

Deductible.  
There is no deductible required to obtain replacement for Your Product.

Transfer.   
This Contract is non-transferable and applies only to the original purchaser as indicated on the Receipt. If the covered device is sold, gifted, or otherwise transferred to another party, this Contract will terminate automatically and will not carry over to the new owner. 

Geographic Availability 
Coverage and service levels under this Contract may vary by region and are only available in supported markets.  

Arbitration.  
Most of Your concerns about the Contract can be addressed by contacting Us at (858) 880-0179. In the event We cannot resolve any dispute relating to this Contract with You, then we both agree that any controversy or claim arising out of or relating to this Contract, or the breach thereof, shall be settled by arbitration before a single arbitrator administered by the American Arbitration Association (the "AAA") in accordance with its Consumer Arbitration Rules. Unless the parties agree otherwise, the arbitration hearing shall be held in the state in which Your Product was purchased. We both give up the right to resolve any controversy or claim arising out of or relating to this Contract in court, whether in front of only a judge, or in front of a judge and a jury. The parties agree to arbitrate solely on an individual basis, and that this agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. Neither the AAA nor the arbitrator shall have the power to consolidate more than one person's claims or to otherwise preside over any form of a representative or class proceeding. A judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Our obligations under this Contract are backed by Our full faith and credit.
